Read the GPL FAQ

In order to comply with the GPL, you need to do a couple of things if you want to redistribute: (simplified)
-keep all copyright notices
-state and include the license
-provide the source

As he obviously does not comply with the first 2, he is acting illegally.

Probably not, for the reasons in Yogi Bear's post.

Ahh....the REAL beauty of GPL: no one gives enough of a damn to enforce it.

Er...I think it'd be pretty much the same thing as if it were copyrighted.

They're doing something illegal either way.

We're just not bothering to stop them because we're focused on development.

Seems like pretty good priorities, no?

Well, JW, you are about to become a lawyer, don't you? How about you take care of taking the time and effort to make these guys behave right?

I don't know if you've noticed, but lately I'm not the most favorite person around here. Also, this isn't my favorite game. Also, that's neither going to be my area of law, nor will I be a lawyer in the next 1.5 years. Another problem is that I don't intend to work for free.

So, I guess if you can wait 2 years, convince me that I should take the case, get some money to pay me, and be satisfied with non-expert representation, sure, we can make this happen.

Otherwise I'm simply making a commentary.

I know i got a little provocative here, but your answer is pretty much what i was hoping for. I am not saying this sarcastically, i am truly honest and serious with it. It is very easy to walk around and ask for justice (or complain that there isn't any) and of course it is also something we would appreciate.

But if it comes to eventually do it, there arise questions like:
- Who should be the one in charge to care for it?
- Who has enough time to do it?
- Who has the knowledge to do it?
- Who is going to spend the money that is needed (maybe)?

Every single of those questions is difficult enough to answer. Together they just build a wall that is near impossible to break through. We all don't even have enough time to care for wesnoth, since everyone of us has a real life, too. We are not talking about a 5 minute job, this would need some real engagement. So it would need a very strong will to "punish the thieves", someone so badly annoyed that he says "yes, i don't want them to get away with that".

In this case, there is no such person. And if the ones that actually did the sprites can live with it - well, who are you and i to tell them different?

I'm sure an arrangement could be reached whereby JW does one hour's legal work in return for a programmer doing one hour's work on a Wesnoth fork. Everyone's a winner :)

That's what I'm saying. It's pointless to complain about people stealing GPL materials, pretty much, unless someone were to make some serious cash breaking it. Anyone not selling their game then ccan freely break the agreement without fear of reprimand.

I'm not demanding justice: I'm pointing out a serious flaw in the agreement that I find rather comical. It's like a country with no military trying to enforce an international treaty: they'll need friends with military power to back it up.

Does Wesnoth have such friends? Hasn't looked like it to this point.
