I don't know. Liberty should be well insulated against that type of thing. Only the custom eras expose multiplayer to USE_L3_OUTLAWS, unless it's another user campaign doing it. The outlaw unit pack could also do it if you edited the config file. Sorry! If you find a bug in any of those, please let me know.
It IS a problem with Liberty, which I will soon fix. I apologize. Thanks for the bug report. I'm not sure how it happened (the #ifdef protecting the bandit was deleted somehow).
Add level 3 bandits in MP, remove the Grand Marshal from MP.

It seems to be difficult enough to get level 3 units in multiplayer. . . I don't think it will make much difference. And having another level to work for makes the game more interesting. I don't see why it shouldn't be left the way it is.
Anyway, I agree that they should be added... there is great art for them, and stats too, would be weird to leave them out... why couldn't there be elite bandits like elite anything else, too?
I agree with level 3 outlaw part, but disagree with the grand marshal removing part.
