Bug: Merman 40/40 XP

At the end of Bay of Pearls, I finished of the 2nd Orc Leader with a Merman and it didn't advance to next level despite 40/40 XP. Only in the following scenario, it advanced to Merman Lord with its first attack.

Yes, this is a known bug. Sometimes when you finish an enemy leader, you don't advance. I am still looking for the best way to fix.
