Legality of using the music?

Hello, I've recently started a FLOSS gaming podcast. And am reviewing Wesnoth. I think it would be nice to use the music of the game we're reviewing in the episode, and want to know if there's any legal issues with using the music from the battle for wesnoth in a CC-BY-SA (possibly CC-BY) podcast.

Since the music's under the GPL, it would't be allowed to use it in something that's not also GPL'd, and CC-BY != GPL... you'd need to choose which piece(s) in particular you want to use and ask their composers if they're willing to re-license it for your use, I think.

Wouldn't a review qualify as fair use anyway?

I don't see why it should be a problem. If every podcast, video, TV reviews had to pay royalties it would be rather complicated...

and yes, it's unrealistically complicated...

Fair use generally covers this sort of thing. Using the music as a background for the entire episode would probably be pushing it, but using clips would be considered fair usage for journalistic purposes.
Lot of grey area on this.

yeah, I kinda agree with aleksi, just do it

if you want to be sure, just license that one emission as gpl instead of CC, but the spirit of these licenses are close enough
