Yes it's a good idea and could be use to mimick paralysis. Are you planing that for an undead like ghouls? It could be also used by a magician specialised in cold attack rather than fire.

Just wondering... would the first non-magical hit vs a frozen enemy be guaranteed to hit?

That is one option, but I think that Kamahawk's suggestion might work better: frozen units cannot be attacked at all.

Better if they cant be attacked.. or they could be just frozen and refrozen again... till death... no matters how powerfull the unit was...

Yes, but you'd have to have alot of freezing units to pull this off!

still, it is probably better that they can't get unfrozen. allowing them to be attacked with odd rules would make the game to complicated, and i like it better with no attack at all anyway.
